These Terms and Conditions ("Terms") govern your access to and use of the Storychat application and website ("Services") operated by PowerFan Inc. ("we," "us," or "Storychat"). By using our Services, you agree to these Terms.
You agree not to:
- Submit illegal, infringing, harassing, hateful, obscene, pornographic, or otherwise objectionable content
- Create, upload, or share content designed primarily for sexual gratification
- Exploit, depict, or sexualize minors in any form, including AI-generated depictions
- Circumvent content filters, age restrictions, or safety features
- Impersonate any person or misrepresent your affiliation
- Use Services for legal, medical, or financial advice without proper qualifications
- Interfere with, disrupt, or attempt unauthorized access to our Services
- Use the Services to generate content that promotes terrorism, self-harm, or violence
You retain ownership of content you create (e.g., characters, chats, stories) but grant Storychat a worldwide, royalty-free, sublicensable license to use, display, and distribute such content within the Services and in promotional materials. You are responsible for your content and any consequences arising from its use or sharing.
All user content is subject to our Content & Safety Guidelines and Community Guidelines. We reserve the right to remove content that violates these policies without prior notice.
Access to certain features requires a paid subscription or the use of in-app currency called Story Points (SP). For details on pricing, billing, refund policy, SP usage, and cancellation terms, please refer to our Subscription & Refund Policy.
All payments are final and non-refundable unless required by law. Users are responsible for any applicable taxes. We are not responsible for overdraft charges or fees from your bank or payment provider.
We may suspend or terminate your account without notice if you violate these Terms or pose a risk to Storychat or its users. Upon termination, your access to Services and licenses granted under these Terms will immediately end.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.
Our Services may link to or integrate with third-party services. We are not responsible for their content, practices, or availability. Analytics tools (e.g., Microsoft Clarity, Google Analytics) may collect data as described in our Privacy Policy.
All content and software provided by Storychat (excluding user-generated content) is owned by PowerFan Inc. or its licensors and protected under intellectual property laws. The name "Storychat" and associated trademarks belong to PowerFan Inc.
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We disclaim all warranties including fitness for a particular purpose, accuracy, availability, or non-infringement. We do not guarantee uninterrupted or error-free service.
To the maximum extent permitted by law, Storychat is not liable for indirect, incidental, special, or consequential damages, or any loss of data or profits. Our total liability shall not exceed the greater of $100 or the total amount you paid in the past 12 months.
You agree to indemnify and hold harmless Storychat, its affiliates, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your content or violation of these Terms.
These Terms are governed by the laws of the State of Nevada, U.S.A. All disputes shall be resolved through binding arbitration in Las Vegas, Nevada, under the JAMS Streamlined Arbitration Rules. Both parties waive the right to jury trials or class actions. Either party may seek injunctive relief in court for intellectual property matters.
We may update these Terms at any time. Material changes will be communicated through the Services or via email. Continued use of the Services after such updates constitutes acceptance of the revised Terms.
- Entire Agreement: These Terms constitute the full agreement between you and Storychat.
- Severability: If any provision is found unenforceable, the remainder remains in effect.
- No Waiver: Our failure to enforce a provision does not waive future enforcement.
- Assignment: You may not assign rights under these Terms without our consent.
